Fatal Midtown Manhattan Manhole Accident Raises Public Safety Questions, Say Shulman Hill Attorneys

The fatal fall of a Westchester County woman into an uncovered manhole in Midtown Manhattan has prompted questions about how the opening came to be exposed and what investigators may uncover in the weeks ahead. The Wall Street Journal reported that Donike Gocaj, 56, died after stepping into an uncovered manhole near East 52nd Street and Fifth Avenue shortly after parking her vehicle. The incident occurred at approximately 11:30 p.m. in one of Manhattan's busiest commercial districts.

Surveillance footage reviewed by Con Edison indicates a multi-axle truck may have dislodged the manhole cover shortly before Gocaj's fall. The utility company is continuing to investigate what happened. “What makes this tragedy particularly unsettling is how quickly an ordinary situation appears to have become a fatal one,” said Alex Shulman, Founding Partner and General Counsel of Shulman & Hill. “The facts reported so far suggest investigators are working to understand how the condition developed in the minutes before the accident, and those findings will be important for both the public and the victim's family.”

The accident took place near East 52nd Street and Fifth Avenue, a busy Midtown corridor surrounded by office towers, hotels, retailers, and tourist destinations. “Understanding exactly how this happened is the most important part of the investigation,” said J.J. Hill, Founding Partner of Shulman & Hill. “The findings will help provide answers for the victim's loved ones and for the public.”

Authorities and utility officials continue to review the circumstances surrounding the incident as the investigation remains ongoing. Shulman & Hill extends its condolences to Ms. Gocaj's family and loved ones during this difficult time.
