Advocacy organization ADAP Advocacy has filed two amicus curiae briefs supporting a legal challenge to the Health Resources Services Administration's 340B Drug Pricing Program. The briefs, filed jointly with CF United, argue that the program has strayed from its original patient-centered mission, becoming increasingly focused on generating revenue for healthcare providers.
The organization's leadership highlighted significant concerns about the program's current implementation. Brandon M. Macsata, CEO of ADAP Advocacy, characterized the 340B Program as a 'cash cow' for healthcare systems, noting that patients are being overlooked while medical debt in the United States has reached an estimated $220 billion.
William Sarraille, ADAP Advocacy's Special Counsel for 340B Issues, emphasized the need to refocus the program on patient benefits. He suggested that the rebate model could be a mechanism to ensure patients understand and potentially benefit from the pricing structures that generate substantial revenue for covered entities.
Guy Anthony, Chair of the ADAP Advocacy 340B Patient Advisory Committee, stressed the program's importance for people living with HIV while calling for meaningful reform. He described the amicus brief as a critical step in protecting a program that many vulnerable patients depend on.
The legal filing represents a significant challenge to the current structure of the 340B Drug Pricing Program, arguing that its expansion has not corresponded with proportional increases in charity care or direct patient benefits. By highlighting disparities in executive compensation and program growth, ADAP Advocacy aims to prompt a comprehensive review of how the program serves its intended beneficiaries.
